TERMS & CONDITIONS OF THE FILLORA.STORE ONLINE STORE

§ 1. Seller details

hereinafter referred to as the “Seller”.

  1. These Terms & Conditions define the rules for using the Fillora.store online store, placing orders, concluding sales agreements, making payments, delivery, returns, complaints and the rights and obligations of the Seller and the Customer.
  2. The Customer may contact the Seller by e-mail at info@fillora.store or by phone / WhatsApp at +48 796 011 956.

§ 2. Store character and products

  1. The store sells cosmetic products, beauty products and selected products intended for professional use in the beauty, cosmetic, aesthetic or aesthetic medicine-related industry.
  2. Some products available in the store may be marked as “professional use only” or with similar wording.
  3. Products intended for professional use should be purchased and used only by persons who have the appropriate knowledge, experience, training, qualifications or legal right required for their safe and lawful use.
  4. Fillora.store does not provide medical services, medical advice, treatment recommendations or instructions for performing aesthetic procedures. Product information available on the website is provided for informational and commercial purposes only.
  5. The Customer is obliged to read the product description, intended use, storage conditions, expiry date, manufacturer information and any restrictions regarding the product.
  6. The Customer is responsible for ensuring that the purchase, import, possession and use of the ordered products are permitted under the laws and regulations applicable in the country of delivery or use.
  7. The Seller reserves the right to refuse or cancel an order if there is a justified suspicion that the product may be used contrary to its intended purpose, contrary to law, or by a person who does not have the required knowledge or qualifications.

§ 3. Definitions

  1. Customer — a natural person, legal person or organizational unit placing an order in the store.
  2. Consumer — a natural person making a purchase not directly related to their business or professional activity.
  3. Entrepreneur — a natural person, legal person or organizational unit making a purchase in connection with their business or professional activity.
  4. Entrepreneur with consumer rights — a natural person concluding an agreement directly related to their business activity, if the agreement does not have a professional character for that person.
  5. Product — an item available in the Fillora.store online store.
  6. Order — a declaration of will submitted by the Customer aimed at concluding a sales agreement with the Seller.

§ 4. Customer account and placing orders

  1. Orders may be placed through the online store at www.fillora.store.
  2. To place an order, the Customer must provide true and current data necessary to complete the order, including name, delivery address, e-mail address, phone number and invoice details, if applicable.
  3. The Customer is responsible for the correctness of the data provided during the order process. The Seller is not responsible for delays or failed delivery resulting from incorrect or incomplete data provided by the Customer.
  4. Placing an order means acceptance of these Terms & Conditions and obligation to pay the price for the ordered products.
  5. The Seller may contact the Customer to confirm data, clarify order details or verify whether a given product may be sold to the Customer.
  6. The Seller reserves the right to refuse or cancel an order if:
    a) the data provided by the Customer is false, incomplete or raises justified doubts,
    b) payment has not been received,
    c) the product is unavailable,
    d) there is a suspicion of violation of law, these Terms & Conditions or security rules,
    e) the order concerns a professional-use product and the Customer has not confirmed the possibility of its lawful and safe purchase or use.

§ 5. Prices and payments

  1. Product prices shown in the store are gross prices, unless otherwise stated on the product page or during checkout.
  2. The store may sell products in EUR, PLN or another currency displayed during checkout.
  3. Available payment methods are shown during checkout.
  4. The order is accepted for processing after payment is successfully received or confirmed by the payment provider, unless another payment method has been individually agreed with the Customer.
  5. The Seller reserves the right to temporarily limit selected payment methods for technical, security or payment provider-related reasons.
  6. In case of order cancellation or accepted refund, the refund will usually be made using the same payment method that was used for the original transaction, unless otherwise agreed.

§ 6. Delivery

  1. Orders are processed on business days, Monday to Friday, excluding public holidays.
  2. The standard order preparation time is usually 1 business day from the moment the payment is successfully received, unless otherwise stated on the product page or during checkout.
  3. Delivery time depends on the destination country, selected delivery method and courier service.
  4. After dispatch, the estimated delivery time is usually 24 to 48 hours from the moment the parcel is handed over to the courier, unless the courier indicates another delivery time or circumstances beyond the Seller’s control occur.
  5. Delivery costs are displayed during checkout before the order is confirmed and paid.
  6. The Seller is not responsible for delays caused by courier companies, customs procedures, force majeure, incorrect delivery details provided by the Customer or other circumstances beyond the Seller’s control.
  7. The Customer should check the condition of the parcel upon delivery. In case of visible damage, it is recommended to prepare a damage report with the courier and contact the Seller as soon as possible.
  8. If the Customer receives a damaged product, the Customer should provide the Seller with photos of the outer packaging, protective packaging and damaged product.

§ 7. Right of withdrawal and returns

  1. Consumers and Entrepreneurs with consumer rights have the right to withdraw from a distance sales contract within 14 days from the date of receiving the product, without giving any reason, unless an exception provided by law applies.
  2. To exercise the right of withdrawal, the Customer should inform the Seller by sending a clear statement to: info@fillora.store.
  3. The product should be returned to the address indicated by the Seller no later than 14 days from the date on which the Customer informed the Seller about the withdrawal.
  4. The Customer bears the direct cost of returning the product, unless otherwise agreed with the Seller or required by applicable law.
  5. Returned products should be complete, unused, undamaged and, where possible, in their original packaging.
  6. The right of withdrawal does not apply in cases provided by law, in particular to products delivered in sealed packaging which cannot be returned after opening due to health protection or hygiene reasons, if the packaging was opened after delivery.
  7. For safety, hygiene and product integrity reasons, sterile products, sealed products, products with broken seals, opened packaging, damaged protective wrapping or signs of use cannot be returned if their resale would be impossible due to health protection, hygiene or safety reasons.
  8. The Seller may withhold the refund until the returned product is received or until the Customer provides proof of return shipment.
  9. The refund will be made without undue delay, no later than within the period required by applicable law, using the same payment method that was used for the original transaction, unless otherwise agreed.
  10. The right of withdrawal does not limit the Customer’s right to file a complaint if the product is not in conformity with the agreement.

§ 8. Complaints

  1. The Seller is obliged to deliver products in conformity with the agreement.
  2. The Customer may file a complaint if the product is defective, damaged, incomplete, not in conformity with the order or does not match the description.
  3. Complaints should be submitted by e-mail to: info@fillora.store.
  4. The complaint should include:
    a) name or company name,
    b) order number,
    c) description of the issue,
    d) photos of the product, packaging and parcel, if necessary,
    e) preferred solution.
  5. The Seller will review the complaint within the period required by applicable law.
  6. If the complaint is accepted, the Seller may, in accordance with applicable law, offer product replacement, price reduction, refund or another solution agreed with the Customer.
  7. A complaint may not be accepted if the problem results from improper storage, incorrect use, opening or damaging the packaging, use contrary to the product’s intended purpose, Customer’s actions, third-party actions or failure to follow the manufacturer’s information.
  8. The Seller is not responsible for the consequences of using the product contrary to its intended purpose, instructions, manufacturer information, safety rules or local legal requirements.

§ 9. Professional-use products and Customer responsibility

  1. In the case of products marked as intended for professional use, the Customer confirms that they have the appropriate knowledge, experience, qualifications or legal right required to purchase, possess and use the product in accordance with its intended purpose and applicable law.
  2. The Customer is responsible for checking whether the product may be legally purchased, imported, possessed and used in the country of delivery or use.
  3. The Seller is not responsible for import, customs, professional, medical, administrative or legal restrictions applicable in the Customer’s country.
  4. The Seller is not responsible for damages resulting from improper use, use by an unauthorized person, use contrary to instructions, use contrary to intended purpose or violation of local laws.
  5. Product descriptions do not constitute medical advice, instructions for performing procedures or treatment recommendations.

§ 10. Technical limitations and product availability

  1. The Seller makes every effort to ensure that product information, prices and availability are up to date.
  2. In case of a technical error, obvious price mistake, incorrect description or lack of product availability, the Seller will contact the Customer to clarify the situation.
  3. If order fulfillment is not possible, the Seller will refund the payment received from the Customer.

§ 11. Personal data

  1. Customers’ personal data is processed in accordance with applicable law and the Privacy Policy available on the store website.
  2. Providing personal data is voluntary, but necessary to create an account, place an order, complete delivery, issue a sales document and handle complaints or returns.
  3. Detailed information regarding personal data, cookies and Customer rights is included in the Privacy Policy.

§ 12. Final provisions

  1. These Terms & Conditions are available free of charge on the store website in a way that allows them to be downloaded, saved and printed.
  2. The Seller reserves the right to amend these Terms & Conditions for important reasons, including changes in law, payment methods, delivery methods, Seller details, store functionality or sales rules.
  3. Orders placed before the amendment of the Terms & Conditions are governed by the Terms & Conditions in force at the time of placing the order.
  4. Matters not regulated in these Terms & Conditions are governed by applicable Polish law.
  5. No provision of these Terms & Conditions is intended to exclude or limit the rights of Consumers granted by mandatory provisions of law.
  6. In case of a dispute, the Customer may contact the Seller to resolve the matter amicably.
